Edmonds Police Officer Arrested for Reported Sex With Woman in His Custody

Bail hearing is Friday for Daniel Lavely, who was booked into the Snohomish County Jail in Everett. Everett Police say he had pulled 28-year-old woman over for jaywalking.

Updated at 1:35: A bail hearing for Daniel Lavely is Friday at 1 p.m. at the Snohomish County Courthouse in Everett.

Updated at 12:12 p.m. Thursday with information from Everett Police Department.

An Edmonds Police officer was arrested today on one count of custodial sexual misconduct in the first degree, a felony.

Daniel Lavely, a 7½-year employee of the department assigned to the patrol division, was arrested by Everett Police and booked at the Snohomish County Jail.

On May 9, Edmonds Police Department received a complaint alleging misconduct on the part of one of its officers, says Sgt.  Mike Blackburn. While on uniformed patrol duty on May 7, the employee reportedly had sexual intercourse with a 28-year-old Seattle woman who was in his temporary custody.

Due to the seriousness of the allegation, the 47-year-old officer, who lives in Edmonds, was immediately placed on administrative leave and his law enforcement authority was suspended, said Blackburn.

"At our request," Blackburn said, "the Everett Police Department investigated the allegation and determined there was probable cause to believe that criminal conduct occurred."

Blackburn says no previous complaints or internal investigations have been filed against Lavely.

Formal criminal charges are expected to be filed by the Snohomish County Prosecuting Attorney.

A determination as to Lavely’s employment status with the city will be made pending an Edmonds Police Department review of the entire investigatory file.

From the Everett Police Department:

On May 9th, 2012 the Edmonds Police Department received allegations of misconduct by Lavely and requested the Everett Police Department complete an investigation. The investigation looked into the actions of Lavely while he was on duty the night of May 6, 2012 when he initially contacted a 28-year-old female resident of Seattle for jaywalking on Highway 99 in Edmonds.

The female was released but was contacted again by Lavely later that evening on an unrelated call. During this second interaction it was alleged that Lavely took temporary custody of the female, put her in his patrol car and drove her to a remote location where the two had sexual intercourse. The female reported the incident a few days later to law enforcement.

If you want to know what it's like to have your religion disrespected, try having school camps,Read More orchestra and band concerts and back-to-school nights on the holiest of your religious holidays (equivalent to Christmas and Easter). Everyone knows that an egg hunt is an Easter event whether it's called that or not. Everyone know that a holiday tree is really a Christmas tree. Trust me, the atheists and/or non-Christians are not trying to destroy Christianity. First, it would be impossible. Second, it would be too dangerous to us personally. Last, I personally respect other's traditions, but I'm not sure the same can always be said in reverse.

Don't we have more important things to worry about? Easter Egg, Egg Hunt, who cares? It's a funRead More community event. And thank you to the sponsers that make this happen.

First of all, the government is not supposed to promote any religion. Secondly, the Easter bunnyRead More and egg hunt has no historical religious significance that I can think of, even though this is part of an American tradition. I am good with deleting the word Easter, and would like to see a departure from any emphasis on candy, which only compounds the diabetic epidemic in this country. Sometimes it is good to rethink the wisdom of something simply because it is a "tradition".
